Acceptance of These Terms

These Terms of Service govern your use of the website at upgradeyou.life, the Anti-Candida Kitchen application, and the sessions, courses, digital products, and services offered by Upgrade You, LLC. By using the site, booking a session, or making a purchase, you agree to these terms. If you do not agree, please do not use the site or services.

Who We Are

Upgrade You, LLC is operated by Jess LeFevre, CHPC, and is based in Orem, Utah, serving clients worldwide remotely and in person within North America. You can reach us at support@upgradeyou.life or through the contact page.

Eligibility

You must be at least eighteen years old to book a session, make a purchase, or create an account. By using our services you confirm that you meet this requirement and that the information you provide is accurate.

Your Account

Some features require an account, created through our authentication provider. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for everything that happens under your account. Your account, and any digital products or course access tied to it, is personal to you and may not be shared, sold, or transferred. Tell us right away if you suspect any unauthorized use. We may suspend or close accounts that violate these terms.

Our Services

Upgrade You offers human potential coaching, energy healing sessions, Munay Ki rites, Qigong and Tao Tan Pai training, online courses, the Anti-Candida Kitchen application, guided meditations, and curated wellness products. Sessions may be delivered remotely or, where arranged, in person. Some sessions can be received while you rest, sleep, or skip the call entirely. The work happens regardless of your participation.

Not Medical Advice

Nothing offered through Upgrade You is medical advice, diagnosis, or treatment, and none of it replaces care from a licensed healthcare provider. Energy healing, shamanic practice, and wellness coaching are complementary practices, not licensed medical treatments. Results are not guaranteed and individual experiences vary. Booking and Payment

To book a session you select a session, complete the intake form, and pay through Stripe Checkout. Available payment methods include card, PayPal, Apple Pay, Google Pay, Link, Cash App Pay, Klarna, Affirm, Afterpay, and crypto, all processed securely through Stripe.

Buy now, pay later options such as Affirm, Klarna, and Afterpay let you pay on a schedule while Jess receives the full amount up front and your booking is confirmed immediately. After payment, Jess reviews your availability and reaches out within 1 to 2 business days to confirm your exact session time.

Pricing

All prices are shown in United States dollars. We work hard to keep pricing accurate, but prices are subject to change at any time. The price shown at checkout is the price that applies to your purchase. Travel intensives and certain advanced trainings are quoted on inquiry.

Refund and Cancellation Policy

Sessions, cancel 7 or more days before your scheduled session for a full refund.

Sessions, cancel between 48 hours and 7 days before for a full credit toward a future session, valid for 12 months.

Sessions, cancel within 48 hours of your session and a credit may be offered at Jess's discretion, otherwise the payment is forfeit.

Intensives priced at 777 dollars or more, cancel 14 or more days before for a full refund.

Intensives, cancel between 7 and 14 days before for a 50 percent refund plus a 50 percent credit toward a future session.

Intensives, cancel less than 7 days before for a credit only.

Buy now, pay later refunds through Affirm, Klarna, and Afterpay are handled automatically by Stripe. Life happens, and Jess works with you in good faith on genuine hardship cases. Because energy work and coaching outcomes cannot be guaranteed, refunds are based on the cancellation schedule above and are never tied to health results.

Digital Products and Licenses

When you purchase a digital product such as the Anti-Candida Kitchen unlock, guided meditations, recipe guides, or course access, you receive a personal, non-transferable, non-exclusive license to use that product for your own personal use.

You may not copy, resell, redistribute, share, or publicly post the product or its files. Course and meditation videos are available to stream only and are not provided as downloads. Because digital products are delivered immediately, they are generally non-refundable once accessed, except where required by law.

Intellectual Property

All content on this site, including text, graphics, logos, photographs, course materials, recipes, meditations, and software, is owned by Upgrade You, LLC or its licensors and is protected by copyright and other laws. You may not use, reproduce, or distribute any of it without our written permission, except for the personal use expressly allowed by these terms.

Acceptable Use

You agree to use the site and services lawfully and respectfully. You will not attempt to gain unauthorized access to our systems, interfere with the site, scrape or copy content at scale, share your account or purchased content with others, or use the services to harm anyone. We may suspend or end access for anyone who violates these terms.

Third-Party Links and Affiliates

Our site links to third-party websites and includes affiliate links. We are not responsible for the content, products, or practices of those third parties, and following a link is at your own risk. When you buy through an affiliate link we may earn a commission at no extra cost to you. See the Affiliate Disclosure for details. You complete any third-party purchase directly with that seller under their terms.

Disclaimers

The site and services are provided on an as is and as available basis without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, error free, or secure, and we make no guarantee of any particular result from any session, course, product, or practice.

Limitation of Liability

To the fullest extent permitted by law, Upgrade You, LLC, Jess LeFevre, and any affiliated parties will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the site or services. Your use of the site and reliance on any content is solely at your own risk.

Indemnification

You agree to defend, indemnify, and hold harmless Upgrade You, LLC, Jess LeFevre, and any affiliated parties from any claims, damages, losses, or expenses, including reasonable legal fees, arising out of your use of the site or services, your violation of these terms, or your violation of any rights of another party.

Governing Law

These terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.

Dispute Resolution and Arbitration

Please read this section carefully, it affects how disputes are resolved. Before starting an arbitration or filing any claim, you agree to first contact us at support@upgradeyou.life and try in good faith to resolve the dispute informally for at least thirty days.

If informal resolution does not work, you and Upgrade You, LLC agree that any dispute, claim, or controversy arising out of or relating to these terms or your use of the site and services, except as carved out below, will be settled by final and binding arbitration before a single arbitrator, not in court. Arbitration is administered by a recognized provider such as the American Arbitration Association or JAMS under its consumer or commercial rules then in effect, seated in Salt Lake City, Utah, conducted in English, and decided under Utah law. By agreeing to arbitration both parties give up the right to a trial by jury and the right to appeal except as the Federal Arbitration Act allows.

Class action waiver. You and Upgrade You, LLC agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not preside over any class or representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim, and only that claim, is severed and may proceed in court while the rest stays in arbitration.

Exceptions and attorney fees. Either party may bring a qualifying individual claim in small claims court, and either party may ask any court of competent jurisdiction for injunctive or equitable relief to protect intellectual property or confidential information, for which exclusive venue is the state or federal courts in Utah. In any arbitration or court proceeding arising out of these terms, the prevailing party is entitled to recover its reasonable attorney fees and costs to the extent permitted by law, and this applies equally to both parties.

Survival

Provisions that by their nature should continue after these terms end, including digital product licenses already granted, intellectual property, disclaimers, limitation of liability, indemnification, governing law, dispute resolution and arbitration, and the general provisions below, survive termination of your use of the site or services.

General Provisions

Entire agreement. These terms, together with the policies they reference, are the entire agreement between you and Upgrade You, LLC about the site and services and replace any prior understanding on the subject.

Severability. If any part of these terms is found unenforceable, that part is limited or removed to the smallest extent necessary, and the rest stays in full force.

No waiver. If we do not enforce a provision right away, we do not give up the right to enforce it later.

Assignment. You may not assign these terms without our written consent. We may assign them, including in connection with a sale or reorganization of the business.

Electronic communications. You consent to receive communications from us electronically, such as by email or by posting on the site, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.

Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control. Section titles are for convenience only.

Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the date shown at the bottom of this page. Your continued use of the site or services after an update means you accept the revised terms.
